Incarceration and Conviction Alternatives Network (ICAN)

ICAN commenced in September 2019 in Tucson, under the direction of District Judge Rosemary Marquez and Magistrate Judge Jacqueline Rateau. It is a post-guilty plea diversion program created in conjunction with the Court, U.S. Attorney’s Office, Federal Public Defender’s Office, and U.S. Pretrial Services. The program is voluntary and upon successful program completion the defendant’s case would either be dismissed, reduced to a misdemeanor conviction, or no term of incarceration would be imposed. The program is designed to provide rehabilitation services to high-risk defendants in a wrap-around approach by addressing individual risks and needs. The program takes a team approach to address both positive and negative behavior in order to facilitate positive prosocial change.

The Youthful Offender Diversion Program (YOUCAN)

YOUCAN is a post guilty plea diversion program established in 2025 under the ICAN program umbrella to provide a diversionary alternative for youthful offenders, ages 18 to 26 years old, who are typically first-time offenders lacking certain life skills and determined to be low risk to the community. While the ICAN program also accepts adult federally charged defendants under 27 years of age, the YOUCAN program was created to provide a less intensive supervision alternative to defendants who may otherwise qualify for ICAN, but do not need the same intensive level of resources and treatment modalities.  The program is voluntary and upon successful program completion the defendant’s case would either be dismissed or reduced to a misdemeanor conviction.
