2025-2026 Proposed Amendments to Local Rules

The United States District Court for the District of Arizona pursuant to 28 U.S.C. §2071 and Local Rule of Civil Procedure 83.9 of the Local Rules of Practice hereby invites comments on the 2025-2026 proposed amendments to the Local Rules of Practice for the District of Arizona. 

All proposed amendments are available for review on this page or upon request from the Clerk of the Court. Comments may be submitted electronically by clicking on the local rule title and adding your comment. Written comments may also be submitted in letter form and be directed to:

LRCiv 1.1(b)

LRCiv 1.1(b) - COURT CALENDAR MANAGEMENT. Proposed amendment to incorporate a reference to the proposed requirements contained in LRCiv 7.3.

LRCiv 3.2(a)

LRCiv 3.2(a) - DOCKETING. Proposed amendment to conform with the proposed amendment to LRCiv 5.1, and to make technical revisions utilizing the initials of active judges.

LRCiv 3.7

LRCiv 3.7 - ASSIGNMENT OF CASES; CIVIL. Proposed amendment adds new subparagraph (d), providing for the assignment of the same judge to any subsequent social security appeal filed by the same claimant, with remaining subparagraphs renumbered accordingly.

LRCiv 5.1(a)

LRCiv 5.1(a) - PLACES FOR FILING. Proposed amendment to rename the Prescott division as the Flagstaff Division.

LRCiv 7.2(h)

LRCiv 7.2(h) - MOTIONS. Proposed amendment to allow for proceedings by video conference, remove unnecessary and outdated language, and add reference to LRCiv 43.1.

LRCiv 7.3 - MOTIONS/STIPULATIONS FOR EXTENSIONS OF TIME. Proposed amendment to require counsel to confer in conjunction with requests for a continuance.

LRCiv 16.2(b)

LRCiv 16.2(b) - DIFFERENTIATED CASE MANAGEMENT. Proposed amendment clarifies the term detainee.

LRCiv 43.1(a-d)

LRCiv 43.1(a-d) - CONDUCT IN COURTROOM AND ENVIRONS. Proposed amendment to (i) allow for use of necessary assistive technology for accessibility; (ii) remove reference to outdated technology devices; (iii) update language regarding parties; (iv) changes “non‑litigation related purposes” to “other purposes.” Proposed amendment to, (i) update the reference to remove the Prescott courthouse, which is no longer leased; (ii) reflect consolidation of U.S. Pretrial Services and U.S. Probation into U.S. Probation and Pretrial Services; (iii) provide the name of the Yuma courthouse; (iv) remove the reference to the AWD Professional building; (v) remove the reference to federally owned buildings.

LRCiv 77.1 - LOCATIONS; HOURS OF CLERK'S OFFICES. Proposed amendment to conform with the proposed amendment to LRCiv 5.1.

LRCiv 83.1(f)

LRCiv 83.1(f) - ATTORNEYS. Proposed technical amendment to remove the incorrect name to Rule 83.2, Local Rules of Civil Procedure.

LRCiv 83.10

LRCiv 83.10 - DISPUTE RESOLUTION. Proposed amendment adds new subparagraph (b) to clarify that bankruptcy judges may conduct settlement conferences in bankruptcy cases only.

LRCrim 46.2 - CASH BOND AND FORFEITURE OF BOND. Proposed technical amendment to correct the reference to Rule 46(d) by replacing it with Rule 46(g), Federal Rules of Criminal Procedure.

LRCrim 49.7 (New)

LRCrim 49.7 (New) - UNSEALING OF CRIMINAL CASES. Proposed new rule sets forth procedures for the unsealing of criminal cases.
